Data collection and scope of use

When you use our Video.Taxi service, we collect and use personal data only if and to the extent that this is necessary to provide the service or to perform the respective function. The term “personal data” means all individual information about an identified or identifiable natural person, such as their contact details or the content of entries in (contact) forms.

Insofar as we collect, process or use personal data, we comply with the applicable legal provisions, in particular the EU General Data Protection Regulation (DSGVO), the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG). Personal data will not be passed on to third parties or used beyond the purpose for which it was collected. Should a forwarding to third parties be necessary to answer an inquiry or to provide a service function, the consent of the person concerned is deemed to have been given in this respect. In particular, the data you provide to us will not be used for advertising purposes (see section: Disclosure of data).

Service users are natural persons who access the Video.Taxi service via any website or application and use it to access content offered by TV1 or Video.Taxi customers free of charge or for a fee.

Categories of personal data of Video.Taxi customers as publishers or publishers of content that may be processed by the controller per contact person or (sub)account:

  • user account and authentication information
  • Bank details (e.g. IBAN, BIC)

  • Connected sub-accounts
  • Tax identification information
  • Website
  • Information on purchase or payment transactions (e.g. transaction number, product name, date of purchase)
  • Information on activities in the respective personal account (e.g. creation of live streams, upload of on-demand content)

Video.Taxi customers are natural or legal persons who provide content for retrieval by service users via the Video.Taxi Internet service provided by TV1 GmbH.

Purposes and legal basis of data processing

We process your personal data on the basis of Art. 6 (1) a), b) and f) DSGVO only for the following purposes:

  • Ensuring a smooth connection setup of the service
  • Ensuring a smooth use of the service functions
  • Enabling access to content, including the processing of payments, where necessary
  • Delivering audio, video, and other content over communication links
  • Ensuring that audio, video, and other content displays correctly on supported devices
  • Evaluation of system security and stability
  • Evaluation of access to service functions and offered content for the creation of statistics

Disclosure of data

We only pass on your personal data to third parties if:

  • you have given your express consent to,
  • the processing is necessary for the performance of a contract with you,
  • processing is necessary for compliance with a legal obligation, or
  • processing is necessary to protect legitimate interests and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

In connection with the specific access to content issued by Video.Taxi customers via our service, we transmit the personal data of the service user collected by us to the respective customer.

In connection with purchase transactions or payment transactions, we transmit the service user’s identification features (e-mail address and name) to our payment service provider. Further data for the processing of such a transaction is collected by the payment service provider directly, and not via the Video.Taxi service or otherwise by TV1 GmbH. For the service user, it is recognizable during the purchase process at which point payment transaction-relevant data is collected directly by the payment service provider.

In addition, we pass on personal data collected through the use of the service to state institutions, authorities and courts, insofar as we are obliged to do so or insofar as this is necessary for efficient legal defense or assertion of rights.

For the operation of the Video.Taxi service, its functions and the underlying technical systems and components, we use technical service providers as subcontractors (see section: Subcontractors). If personal data is transferred to these service providers, this is done as part of a commissioned processing of personal data pursuant to Art. 28 DSGVO.

Subcontractors

The following service providers are engaged as subcontractors with a commissioned processing of personal data:

  • Amazon Web Services (AWS): web hosting
  • Braintree Payments: processing of payments (to access paid offers)
  • KIM Keep In Mind GmbH: software development, support
  • Zendesk Inc.: support tool

Deletion of data

We adhere to the principles of data avoidance and data economy. We therefore only store your personal data for as long as is necessary to achieve the above-mentioned purposes or as stipulated by the storage periods provided by law. After the respective purpose has ceased to exist or these periods have expired, the corresponding data is routinely blocked or deleted in accordance with the statutory provisions.

Billing-relevant personal data of service users (e.g. information on purchase transactions or payment transactions as well as information on purchase transactions), which are processed in the context of the use of Video.Taxi when accessing paid content, must be stored for six years due to legal requirements and will be deleted after this period has expired.

Further technical information

The Video.Taxi player may be embedded in various websites. TV1 GmbH is generally not the provider or operator of these websites. Functions for booking and technical setup of the service are made available to Video.Taxi customers as publishers or editors of content via the website www.video.taxi. All parameters relevant to data protection are preset in a data protection-friendly manner. Cookies

Like many other web services, we also use so-called “cookies”. A cookie is a small file that is stored on your computer. The contents of this file are transferred to our web server every time you visit our website. Cookies cannot be used to launch programs or transfer malware to a computer. Based on the information contained in cookies, we can, among other things, facilitate your use of the service and enable the correct display of our functions and content. To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS.

Contact us

If you contact us by e-mail or contact form, you give us your voluntary consent to collect and store your e-mail address, name and, if necessary, other personal data for the purpose of contacting you. E-mail address and name are used for the assignment of the request and its subsequent response. The provision of further data is optional. The information you provide will be stored for the purpose of processing the request and for possible follow-up questions. After completion of your inquiry, this personal data will be deleted.
